Chief Justice Islamabad High Court Atharmanullah heard the request of former chairman Hilal Ahmar Pakistan Dr Saeed Elahi and asked Attorney General Anwar Mansoor to inform the law whether the appointment is a special appointment.
The lawyer petitioner told the court that the managing body had made the rules under which the chairman would be appointed for 3 years, on which Chief Justice Athar Mannullah said, "Where is the way to remove the chairman?" On this occasion, the court questioned the Attorney General that the managing body made the rules, how it could be removed from office, the chairman could not be fired under Rule 10A.
The Attorney General said that the executive has the power to dismiss the chairman at any time; notification of the chairman's dismissal has not been challenged; there is no charge against the chairman so he has not been notified.
The Chief Justice remarked how the government can remove the chairman, despite his role in the law. The court issued notices to the Attorney General, Establishment Division, Abrar-ul-Haq and others and sought response.
